1. FLIGHT TICKETS


     TERMS OF THE AIRLINES

(i). The airline tickets available through the Website are subject to the terms & conditions of the concerned airline, including but not limited to cancellation and refund policies.

(ii). Adimudra merely acts as a facilitator to enable the User to book a flight ticket. The contract of service for utilization of the flight is always between the User and the concerned airline.

(iii). Airlines retain the right to reschedule flight times, route, change or cancel flights or itineraries independent of and without prior intimation to Adimudra. As a facilitator Adimudra has no control or authority over the logistics of the airlines and therefore is not liable for any loss, direct or incidental, that a User may incur due to such change or cancellation of a flight.

(iv). The baggage allowance on given fare is as per the terms decided by the airline, and Adimudra has no role to play in the same. Some of the fares shown in the booking flow are “hand baggage fares” which do not entitle the User for free check in baggage and therefore the User will be required to pay separately for check in baggage. The prices for adding check-in baggage to a booking may vary from airline to airline. The User is advised to contact the airlines for detailed costs.

CODE SHARE

(v). Some airlines enter into "code share" agreements with other Airlines. This means that on certain routes, the airline carrier selling or marketing the flight ticker does not fly its own aircraft to that destination. Instead, it contracts or partners with another airline to fly to that destination. The partner airline is listed as "operated by" in the booking flow.

(vi). If your flight is a code share, it will be disclosed to you in the booking process and prior to payment.

(vii). Adimudra will disclose any such code-share arrangements to the User, only when the ticketing airline discloses it to Adimudra in the first place.

PRICING

(viii). The total price displayed on the Website on the payment page usually includes base fare, applicable government taxes and convenience fee. Users are required to pay the entire amount prior to the confirmation of their booking(s). In the event the User does not pay the entire amount, Adimudra reserves its right to cancel the booking. User agrees to pay all statutory taxes, surcharges and fees, as applicable on the date of travel.

(ix). To avail infant fares, the age of the child must be under 24 months throughout the entire itinerary. This includes both onward and return journeys. If the infant is 24 months or above on the return journey, User will be required to make a separate booking using a child fare. Any infants or children must be accompanied by an adult as per the terms of the airlines.

TRAVEL DOCUMENTS

(x). It shall be the sole responsibility of the User to ensure they are in possession of valid travel documents such as identity proof, passport, visa (including transit visa) etc. to undertake the travel. User agrees that in case of inability to travel for not carrying valid travel documents, Adimudra shall in no way be held liable.

(xi). User understands that the information (if any) provided by Adimudra regarding the travel documents is only advisory in nature and can’t be considered conclusive. The User shall ensure checking the requirements of travel with the respective airlines of the respective jurisdictions the User may transit through or choose to visit.

CHECK-IN TERMS

(xii). User should check with the airlines directly regarding the check-in timings. Usually, check-in begins 2 hours before departure for domestic flights, and 4 hours before departure for international flights.

(xiii). User should carry valid identification proofs, passport, age proofs as may be required to prove the identity, nationality and age of the passengers travelling on a ticket, including infants.

USE OF FLIGHT SEGMENTS

(xiv). In the event User does not embark on the onward journey, the entire PNR pertaining to that booking shall be automatically cancelled by the airline. In such a scenario Adimudra has no control in the said process nor will be obligated to provide alternate bookings to the User. The cancellation penalty in such an event shall be as per the applicable airline rules.

CHANGES TO EXISTING BOOKING

(xv). Any changes that are made to any existing booking shall be subject to certain charges levied by the respective airline, apart from the service fee charged by Adimudra.

(xvi). The User shall be obligated to pay applicable charges in the event of any alteration or modification to an existing booking. However, depending on the airline's policy and fare class, charges for changes or modifications to existing bookings may vary.

REFUND

(xvii). Refunds will be processed as per the airline fare rules and cancellation policy. Such refunds shall be subject to Adimudra receiving the same from the airlines. However, the convenience fee paid to Adimudra paid at the time of booking is a non-refundable fee.

(xviii). All cancellations made directly with the airline need to be intimated to Adimudra, in order to initiate the process of refund. The processing time for refunds may vary depending on the mode of payment, bank etc. The refund shall be processed after deducting the Adimudra service fee which is independent of the convenience fee as mentioned above.

(xix). The refund will be credited to the same account from which the payment was made. For example, if the User used a credit card, Adimudra will make an appropriate charge reversal to the same credit card; like-wise if the User used a debit card, Adimudra will credit the money to the same debit card.

(xx). In the event of cancellation and refund of partially utilized tickets, upfront discount and promo code discount availed at the time of booking would be deducted from the refund amount.

2. HOTELS


ROLE OF Adimudra AND LIMITATION OF LIABILITY OF Adimudra

(i). Adimudra acts as a facilitator and merely provides an online platform to the User to select and book a particular hotel. Hotels in this context includes all categories of accommodations such as hotels, home-stays, bed and breakfast stays, farm-houses apartmentsand Villas and any other alternate accommodations.

(ii). All the information pertaining to the hotel including the category of the hotel, images, room type, amenities and facilities available at the hotel are as per the information provided by the hotel to Adimudra. This information is for reference only. Any discrepancy that may exist between the website pictures and actual settings of the hotel shall be raised by the User with the hotel directly, and shall be resolved between the User and hotel. Adimudra will have no responsibility in that process of resolution, and shall not take any liability for such discrepancies.

INFORMATION FROM THE HOTEL AND THE TERMS OF THE HOTEL

(iii). The hotel booking voucher which Adimudra issues to a User is solely based on the information provided or updated by the hotel regarding the inventory availability. In no circumstances can Adimudra be held liable for failure on part of a hotel to accommodate the User with a confirmed booking, the standard of service or any insufficiency in the services, or any other service related issues at the hotel. The liability of Adimudra in case of denial of check-in by a hotel for any reason what-so-ever including over-booking, system or technical errors, or unavailability of rooms etc., will be limited to either providing a similar alternate accommodation at the discretion of Adimudra (subject to availability at that time), or refunding the booking amount (to the extent paid) to the User. Any other service related issues should be directly resolved by the User with the hotel.

(iv). Hotels reserves the sole right of admission and Adimudra has no say whatsoever in admission or denial for admission by the hotel. Unmarried or unrelated couples may not be allowed to check-in by some hotels as per their policies. Similarly, accommodation may be denied to guests posing as a couple if suitable proof of identification is not presented at the time check-in. Some hotels may also not allow local residents to check-in as guests. Adimudra will not be responsible for any check-in denied by the hotel due to the aforesaid reasons or any other reason not under the control of Adimudra. No refund would be applicable in case the hotel denies check-in under such circumstances.

RESPONSIBILITIES OF THE USER

(v). The User would be liable to make good any damage(s) caused by any act of him/ her/ or their accompanying guests (wilful/negligent) to the property of the hotel in any manner whatsoever. The extent and the amount of the damage so caused would be determined by the concerned hotel. Adimudra would not, in any way, intervene in the same.

(vi). The primary guest must be at least 18 years old to be able to check into the hotel.

(vii). The User has to be in possession of a valid identity proof and address proof, at the time of check-in. The hotel shall be within its rights to deny check-in to a User if a valid identity proof is not presented at the time of check-in.

(viii). Check-in time, check-out time, and any changes in those timings, will be as per hotel policy & terms. Early check-in or late check-out request is subject to availability and the hotel may charge an additional fee for providing such services.

ADDITIONAL CHARGES BY THE HOTEL

(ix). The booking amount paid by the User is only for stay at the hotel. Some bookings may include breakfast and/ or meals as confirmed at the time of booking. Any other services utilized by the User at the hotel, including laundry, room service, internet, telephone, extra food, drinks, beverages etc. shall be paid by the User directly to the hotel.

(x). Hotels may charge a mandatory meal surcharge on festive periods like Christmas, New Year's Eve or other festivals as decided by the hotel. All additional charges (including mandatory meal surcharges) need to be cleared directly at the hotel. Adimudra will have no control over waiving the same.

PAYMENT FOR BOOKINGS AND ANY ADDITIONAL PAYMENTS

(xi). Booking of a hotel can either be “Pre-paid”, or “Pay at hotel” as per the options made available by a hotel on the Website of Adimudra.

(xii). In “Pre-paid” model, the total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the hotel reservation rate, taxes, service fees as may be charged on behalf of the actual service provider, and any additional booking fee or convenience fee charged by Adimudra.

(xiii). At the hotels or Adimudra’s sole discretion on case to case basis, the User may also be provided with an option to make a part payment to Adimudra at the time of confirmation of a booking. The balance booking amount shall be paid as per the terms of the bookings. For security purposes, the User must provide Adimudra with correct credit or debit card details. Adimudra may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.

(xiv). Some banks and card issuing companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand, e.g. Visa, MasterCard, American Express) are in different countries. If a User has any questions about the fees or any exchange rate applied, they may contact their bank or the card issuing company through which payment was made.

(xv). Some accommodation suppliers may require User and/or the other persons, on behalf of whom the booking is made, to present a credit card or cash deposit upon check-in to cover additional expenses that may be incurred during their stay. Such deposit is unrelated to any payment received by Adimudra and solely at the behest of the Hotel.

(xvi). In “Pay at hotel” model, the concerned hotel will collect the entire payment against the booking at the time of check-in. In case of international bookings, the payment will be charged in local currency or in any other currency, as decided by the hotel. For security purposes, the User must provide Adimudra with correct credit or debit card details. Adimudra may cancel the booking at its sole discretion in case such bank or credit card details as provided by the User are found incorrect.

PAYMENT FOR BOOKINGS AND ANY ADDITIONAL PAYMENTS

(xvii). The Website may contain links to third party websites. Adimudra does not control such websites and is not responsible for its contents. If a User accesses any third-party website, the same shall be done entirely at the User’s risk and Adimudra shall assume no liability for the same.

(xvii). Adimudra is not responsible for any errors, omissions or representations on any of its pages, links or any linked website pages to the extent such information is updated or provided directly by the Service Providers or the advertisers.

(xviii). Adimudra does not endorse any advertisers on its Website, or any linked sites in any manner. The Users are requested to verify the accuracy of all information provided on the third-party web pages.

(xix). The linked sites are not under the control of Adimudra and hence Adimudra is not responsible for the contents of any linked site(s) or any further links on such site(s), or any changes or updates to such sites. Adimudra is providing these links to the Users only as a convenience.

3. BUS


ROLE OF Adimudra

(i). Adimudra only provides a technology platform that connects intending travelers with bus operators. It doesn’t operate any bus or offer the service of transportation to the User. Adimudra also doesn’t act as an agent of any bus operator in the process of providing the above-mentioned technology platform services.

(ii). The bus ticket booking voucher which Adimudra issues to a User is solely based on the information provided or updated by the bus operator regarding the seat availability.

(iii). The amenities, services, routes, fares, schedule, bus type, seat availability and any other details pertaining to the bus service are provided by the respective bus operator and Adimudra has no control over such information provided by the bus operator.

LIMITATION OF LIABILITY OF Adimudra

In its role as a technology platform to facilitate transactions between the bus operators and the Users, Adimudra shall not be responsible for the operations of the bus operator including, but not limited to the following:

(iv). Timely departure or arrival of the bus;
(v). The conduct of bus operator's employees, representatives or agents;
(vi). The condition of the bus, seats etc. not being up to the customer's expectation or as per the description provided by the bus operator;
(vii). Cancellation of the trip due to any reasons;
(vii). Loss or damage of the baggage of the customer;
(ix). The bus operator changing a customer's seat for any reason whatsoever;
(x). Bus operator informing a wrong boarding point for the issuance of the booking confirmation voucher, or changing such boarding point eventually with or without any notification to Adimudra or the User;
(xi). Bus operator using a separate pick-up vehicle to transport the User from the designated boarding point to the actual place of departure of the bus.
RESPONSIBILITIES OF THE USERS

Users are advised to call the bus operator to find out the exact boarding point, or any information which they may need for the purpose of boarding or travel in that trip.

(xii). At the time of boarding the bus, Users shall furnish a copy of the ticket, and any valid identity proof like aadhar card, passport, PAN card or voter identification card or any other identity proof issued by a government authority.
(xiii). Users are required to reach the boarding place at least 30 minutes before the scheduled departure time.
(xiv). All tickets issued shall be non-transferable and non-refundable.
(xv). User needs to compulsorily obtain a bus ticket at the regular fare in case a child above the age of 5 years is accompanied by them, unless otherwise a particular bus operator specifies otherwise in their terms and conditions.
CANCELLATION OF TICKET
(xvi). Cancellation of tickets can be done either through the User’s login in the Adimudra’s website or mobile application, or by calling on the customer care number;
(xvii). Any cancellation is subject to such cancellation charges as mentioned on the ticket.

4. CABS


DEFINITIONS

(i). “Cab” as may be used in this document includes all categories of transport vehicles like sedans, hatchbacks, sport utility vehicles, multi utility vehicles, and any other vehicle meant for transporting passengers.

(ii). “Cab Operator” means all the cab operators providing their vehicles alongwith their drivers;

TYPES OF CAB BOOKINGS FACILITATED BY Adimudra
(iii). Outstation Cab: This enables User(s) to book vehicles operated by cab operators having All India Tourist Permit (AITP) vehicles and operating between two separate cities. On the basis of the demand/requirement of the User, Adimudra as a facilitator connects the User with the concerned cab operator.
(iv). Car Rental (intracity and intercity): This enables User to book vehicles operated by cab operators having AITP license on hire/rental basis. This service shall be provided for both intercity and intracity on exclusive basis by booking the entire Vehicle of the cab/taxi operators.
(v). Airport Drop: This shall exclusively cater to the needs of User intending to travel from and to the Airport. The service provided is intracity in nature and shall not facilitate the User to book intercity Airport drops.

ROLE OF Adimudra AND LIMITATION OF LIABILITY
(vi). Adimudra does not operate cab services on its own. In order to provide a comprehensive choice of cab services, cab types and prices to User, it has tied up with many Cab Operators.
(vii). Adimudra acts only acts a facilitator between the Cab Operator and User. The transaction is always between the Cab Operator and the User.
(viii). It is the sole responsibility of the Cab Operator to ensure it has all the requisite licenses, approvals, insurance and permits from appropriate authorities required to undertake the travel booked. Adimudragives no warranty or assurance in regard to requisite licenses, approvals, insurance and permits which the Cab Operator is supposed to obtain from appropriate authorities.
(ix). Adimudra shall not be responsible in any manner whatsoever for any claims with respect to the trip including without limitation, claims pertaining to timeliness, safety, continuity, uninterrupted travel, quality, conditions of vehicle or driving skill, the Cab not departing or reaching on time, behavior of the cab driver, interiors of the Cab, cancellation of the trip by the Cab Operator due to any reason whatsoever, the baggage of the User getting lost, stolen or damaged, the Cab Operator providing a different type of Cab to the User, the User waiting at the wrong boarding point, the User being dropped to nearest location by the driver of the Cab due to any unavoidable circumstances, or any act or omission of Cab Operator causing accident, loss of life to the User.
(x). Adimudra will not be liable to User or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by User through usage of Website, in so far as such information is provided by the Cab Operator.
(xi). In case of break down or accident of Cab where Cab Operator has been unable to make alternative arrangement, Adimudra shall provide proportionate refund to User for uncovered distance. Any claims, liabilities or legal costs arising out of such event shall be borne by the Cab Operator.

PAYMENT FOR BOOKINGS AND ANY ADDITIONAL PAYMENTS
(xii). Booking of a Cab can either be “Prepaid”, or “Part Payment” as per the options made available by the Cab operator on the Website of Adimudra.
(xii). In “Prepaid” model, the total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the base fare,
applicable taxes, service fees as may be charged on behalf of the Cab operator, and any additional booking fee or convenience fee charged by Adimudra.
(xiii). In “Part Payment” model, the User is required to pay a specific percentage of the total booking amount at the time of making the booking and balance
payment shall be made directly to the driver at the time of check-in.
(xiv). Any booking is subject to applicable cancellation policy set out on the booking page or as communicated to the User(s).
(xv). In case of Car Rental and Outstation Cab bookings, the booking amount paid does not include toll charges, interstate taxes, passenger taxes or any other applicable levies and the same shall be borne by the User.
(xvi). Expenses like toll charges, permit charges, parking charges, entry fees, Service Tax & any other Government Tax as per Government guidelines are to be borne by the User and paid directly to the driver.
(xvii). The estimate cost provided at the time of booking is not to be construed as the final pricing for your trip unless specifically indicated. The final amount for your trip will be calculated based on actual usage (number of Kilometers and hours). Distance and time are calculated from garage to garage and not from the pick-up of the User for both within city and outside city trips.
(xviii). The travel allowance wherever applicable has to be paid directly to the driver.

RESPONSIBILITIES OF THE USERS
(xix). The User must carry a valid photo-id proof during the trip and present the same to the Cab Operator or driver of the Cab before boarding the Cab. In the event of a mismatch in the identity of the User or traveler, the Cab Operator or the driver of the Cab may, at their discretion, deny boarding to such User.
(xx). Cab Operator is obligated to commence the trip as soon as the User boards the Cab. User shall report to Adimudra in case the driver denies to commence the trip for any reason whatsoever.
(xxi). User shall board the Cab on or within such time as informed at the time of booking or provided in the booking voucher. In case the User fails to board the cab within the given timeline, Cab Operator will have the liberty to cancel the booking without informing the User.
(xxii). User will not have any right, title or interest in the Cab provided for the given trip.
(xxiii). Once a Trip is booked by User, changes in departure time, boarding or dropping points are not permitted.
(xxiv). Any failure by User to board the Vehicle within the given timelines at the boarding point or trip commencement point, shall result in forfeiture of the total booking amount paid by the User without any refund rights.
(xxv). User shall stop and take breaks at specified places only. User shall avoid taking additional breaks except in case of emergency.
(xxvi). User shall be responsible and liable for their own safety and security of luggage. Adimudra shall not be responsible for any loss to User or their luggage in any event.
(xxvii). In the event of any dissatisfaction with any of the services provided by Cab Operator or Adimudra, the matter must be reported directly to Cab Operator or Adimudra, in order that appropriate action may be taken to remedy the problem.
(xxvii). The booking made by the User should be strictly for tourism purposes only.
(xxviii)The trip should be undertaken in the User’s personal capacity and shall not be used for profit making in any commercial context.

DO’s AND DON’Ts FOR THE USER

THE USER SHALL:
(xxix). Arrive on time at the appointed pick up point as mutually agreed with Cab Operator;
(xxx). Maintain and ensure good and humble conduct with Cab Operator during the trip and on failure to do so, Cab Operator may require such User to disembark the Cab;
(xxxi). Prior to commencement of trip, check and agree with Cab Operator on dimension/weight of the luggage that can be accommodated in the boot space of the Cab;
(xxxii). Check the starting time and the reading on the odometer at the start of the trip. Disputes regarding the same will not be acceptable after completion of journey.

THE USER SHALL NOT:
(xxxiii). ask Cab Operator to violate any traffic rules, or the city police or government rules or other applicable laws for any reason whatsoever;
(xxxiv). coerce Cab Operator to overload the boot space of the Vehicle with the User’s luggage;
(xxxv). use services offered under this head for any purpose which is unlawful or illegal under the applicable laws;
(xxxvi). insist on disembarking at any place expect the point of drop as provided by the User at the time of booking;
(xxxvii). board the Cab if he/ she is intoxicated or under influence of any drug or similar abusive substances.


5.Travel Insurance


It is a condition of your booking that you and all other members of your party, including infants and children, are adequately insured. Adimudra acts as facilitator only for all Insurance Products, any claims, disputes etc. shall be serviced by the Insurance Service Provider/ Insurance Company only. Users constitute no rights for any claim rejections, amount disputes or any disputes against the duly underwritten Insurance Policy by the Insurance Company. We cannot accept responsibility for any loss that you or anyone travelling on your booking suffers if the individual is not adequately insured.

6. Visas


The Travel Partner assures that any visa applications submitted are only genuine cases, and takes full responsibility of the client / passengers / traveller. The Travel Partner ensures to adhere to all requirements imposed by the Immigration and consulate of all the countries through your office with regards to the documentation for the Visa application. The Travel Partner irrevocably indemnifies, keep indemnified, saved and harmless Adimudra, its officers, employees, agents, from and against all cost, charges, claims, damages and the like that may arise or be attributable to any or all such passengers defaulting in their terms & conditions for grant of Visa to visit the required countries and whose applications are submitted through us. The Travel Partner agrees that it has agreed for Adimudra to carry out processing of Visa application for the different countries. Adimudrarole is limited to accepting the visa application and required documentation, forwarding the application to the consulate and immigration authorities for consideration of visa issuance and communication on the application. Visa Applications are considered on individual merit, the consulate and the Immigration Department has the right to seek additional information at any stage of processing. Immigration Authority and the consulate reserve the right to approve or refuse a visa without assigning any reason whatsoever. The decision to grant or refuse a visa is the sole prerogative of Immigration Department and consulate of the respective countries. Adimudra cannot have any influence on the same issue.

Once Visa applied is chargeable irrespective of Visa grant or rejection by the immigration / consulate. It is the Travel Partner’s responsibility to verify the documents correctly before sharing it or submitting it to Adimudra i.e. (Passport front and back page should be same, photograph, additional documents for Minor, observation page on passport, and any other forms or documents required by the immigration / consulate).
It is the Travel Partner’s responsibility to check the visa category correctly before sending any requests. For OK to Board message for the required countries, the Travel Partner needs to advise Adimudra of the PNR at least 72 – 48 hours prior to the Guest Departure during normal working days and 96 – 72 hours prior to weekends; i.e Friday and Saturday. It will be the Travel Partner’s responsibility to verify and reconfirm the message with airlines before 24 hours prior. Adimudra has complete rights to reject any application as per its quality check norms and profile of the passenger. Both parties agrees to all terms and conditions narrated in this agreement. Adimudra hereby declares that they have no role whatsoever in the assessment of a visa application, which is the sole prerogative of the government of the particular countries’ consulate and Immigration department. Therefore, Adimudra will not, in any manner, be liable or responsible for any delay in the processing or rejection of any visa applications. Issuance and Approval of a visa is solely regulated by government of the particular country applying the visa and governed by their rules and regulations that may be amended from time to time. Once applied, Visa fee is non-refundable under any circumstances whatsoever.

In case of rejection of visa application, the applicant will be informed. No correspondence will be entertained, no visa fees will be refunded and no reasons will be required to be given. It is understood that whenever the processing of the visa application is prevented, delayed, restricted or interfered with for any reasons whatsoever by the consulate and Immigration authorities to process visitor application, then Adimudra shall not be liable to any visitor for any loss or damage which may be suffered as result of such causes and Adimudra shall be discharged of all its obligations hereunder. Adimudra shall not be liable for any losses or damages, which the guest may suffer arising from delay in processing or receiving the visa. Adimudra shall take all reasonable measures to ensure that information provided by the guarantor/visitor in its application form shall remain confidential. However Adimudra shall not be liable for any unauthorized access by any means to that information. Adimudra will not be liable for fine to be paid for the passenger if he/she was involved in any criminal offences.

To allow or revoke an applicant from entering the country will be decided by the immigration officers at the port of entry. Adimudra will not be responsible for the decision of the immigration officer. Adimudra will not be liable for delayed approvals in case of systems errors or any other technical issues at the Consulate or at the Immigration. Adimudra will not be liable for any damages, loss and delay of documents in courier services, any third party or during any natural calamities. Courier charges are not included in visa charges.

To defend personal information and to avoid illegal access, we have put in place proper safety measures and certifications. While no system is full-proof, including ours, we will continue using internet security procedures to make sure that your data remains secure with us. By opening, browsing, using this site for transactions or storing any data/information, the Travel Partner agrees to fulfil with the latest revised privacy policy in effect at such time. If the Travel Partner uses some social networking or other service which maintains your information, it is governed by their terms of use and privacy policy. While Adimudra utilizes necessary security measures, it is limited by technology used for different processes by Adimudra and/or by its partners. Adimudra is not in any way accountable for any data loss happening from malicious attempts to compromise its or partners/suppliers systems. The Travel Partner agrees with such limitation and experience.

The Travel Partner hereby declares and undertakes to you that it shall ensure that all its’ passengers strictly adhere to the Flight schedule submitted at the time of submission of the Visa application form. The Travel Partner takes full responsibility of all passengers for whom it submits the visas. Also, the Travel Partner assures that all passengers will depart from the country within the validity of the Visa period, however if any of its passengers do overstay or are absconding on sponsored visa, then the Travel Partner is liable to pay Adimudra the stipulated penalty decided by the consulate/ immigration authorities within 5 working days of notification by Adimudra as per the rate of exchange on that day. Also, the Travel Partner confirms that the visitor will not work anywhere or violate specially UAE/Oman/Bahrain/Qatar and sponsored visas for all other countries law while under Adimudra sponsorship. Should the person found guilty, in whatsoever situation, the Travel Partner has to bear the penalty if it comes from consulate/ immigration authorities/ suppliers /local authorities to Adimudra. The Travel Partner shall also bear the penalty even If any of such liabilities are routed via third party suppliers/ associates/ or other parties through which the transaction is routed.

7. ACTIVITIES AND OTHER SERVICES


DEFINITIONS
(i). ‘Activity’ includes day tours & sightseeing, spa & wellness, adventure sports, cruise, theme/ amusement parks, buffets & dining or any other service/product booked on the Website.
(ii). The provider of the Activity will be referred as ‘Activity Provider’, who shall be solely responsible for provision of the products/ services booked by the User.

ROLE OF Adimudra AND LIMITATION OF LIABILITY
(iii). Adimudra’s role is limited to facilitating the procurement of an Activity service by the User from the Activity Provider. The transaction or the service fulfilment relation is always between the User and the Activity Provider.
(iv). Adimudra shall not provide pick up and drop facility for any Activity unless otherwise explicitly mentioned in the confirmation of the reservation.
(v). Adimudra shall not be liable or responsible for:
(vi). Any damage or loss, injury, accident, death, breakdown, irregularity, delay/change in schedule, cancellation without cause, inaccurate information, deficiency of service/product, or cancellation due to conditions not under the control of Activity Provider;
(vii). The health, safety and well-being of the User in the course of availing the Activity or thereafter;
(viii). Any incidental or ancillary services which is directly purchased by the User from the Activity Provider;
(ix). Any incorrect information provided by the Activity Provider.
(x). The maximum liability of Adimudra will be limited to refund of booking amount which was received by Adimudra for reservation of the Activity.

RESPONSIBILITIES OF THE USERS
(xi). The User agrees to comply with the terms and conditions of Activity Provider in addition to Adimudra’s User Agreement and Terms of Service.
(xii). The User will be required to present the booking / confirmation voucher issued by Adimudra in order to avail the Activity.
(xiii). The User shall further be in possession of valid documents viz. identity proof, address proof, passport in case of Activity booked outside India or any other document as specified by the Activity Provider in order to utilize the Activity booked.
(xiv). The User may be required to sign a waiver/consent form, safety procedure form, medical declaration or other document before availing the Activity where mandated by the Activity Provider.
(xv). The User shall reach out to Activity Provider directly for any concerns subsequent to the confirmation of reservation.
(xvi). The User should ensure that he qualifies all the eligibility criteria for availing the Activity including but not limited to age limit, weight limit, medical conditions etc. User understands that in case he is found unfit or illegible for the Activity, Activity provider may or may not allow the User to avail the said Activity.

PAYMENTS FOR BOOKINGS, AND CANCELLATIONS
(xvii). Reservations will be subject to cancellation and refund policies of the Activity Provider which may vary from time to time.
(xviii). Adimudra may charge applicable taxes or service charge, convenience fees etc. wherever applicable.

SPECIAL OFFERS AND COUPONS

The following terms will additionally apply to any coupon provided by Adimudra:

(xix). Adimudra’s responsibility is limited to sharing the coupon with the User subject to receipt of payment from the User;
(xx). The redemption of coupon is User’s responsibility, and providing the service will be the Activity Provider’s responsibility;
(xxi). The expiry date of the coupon shall be mentioned on the coupon and the User will not be able the use the coupon subsequent to the date of expiry;
(xxii). The coupon is not redeemable for cash;
(xxiii). The coupon once purchased cannot be refunded or cancelled.

Agent/Retailor Terms and Conditions
(i). Payment due to Domestic/International Tickets for the weekly credit to be made within 6 days of the closing of the week (starting from 1st to 7th of the month) or as per the Collection period notified by ADIMUDRA from time to time.
(a). Voiding would be as per the airline norms plus Rs.200/ - per ticket as a ADIMUDRA RAF Charges.
(b). Refund charges would be as per the airline norms plus Rs.300/ - per ticket as a ADIMUDRA RAF Charges.
(ii). Service charges levied are to be collected from the customers on our behalf.
(a). Any voidation/cancellation of the ticket will be entertained only till 1800 Hrs.
(b). If the payment is not made on time Adimudra can anytime cancel all the PNR’s/Tickets without any prior notice.
(iii). Any kind of Misuse of Airline/GDS PNR will solely be the responsibility of the agent and the amount will be recovered from the agent as a when received the debit note by the Airline or by the GDS.
(iv). here will no adjusting of the refund in the payment schedule. The refund will be given back to the agent whenever we have received it from the airline.
(v). TDS will be deducted as per the law. TDS will be deducted on all commissions/incentives. The TDS certificate will be issued in the next Financial Year.
(vi). Responsibility for Taxes. Travel Agent acknowledges that, regardless of any action taken by Adimudra, the ultimate responsibility for Tax Collected at Source (‘TCS’) under section 206C(1G) or any other taxes as may be legally applicable and filing requirements in connection with the same thereof (hereinafter collectively referred to as ‘Tax Obligations’), is and shall remain his (or her) responsibility.
(vii). The credit limit will be on a weekly basis depending upon the certain guarantees.
(viii). ny advance amount paid by the agent will be non-interest bearing and should be utilized within 360 days from the date of payment. If such advance is not utilized within this period of 360 days, the unutilized portion shall be held in trust, for the benefit of the agent, by Adimudra for a period of 2 years from the date of payment of such advance after which the same shall be deemed as forfeited.
(ix). he User shall request adimudra for any refunds against the unutilized or 'no show' air or hotel booking for any reasons within 90 days from the date of departure for the air ticket and/or the date of check-in for the hotel booking. Any applicable refunds would accordingly be processed as per the defined policies of Airlines, hotels and adimudra as the case may be. No refund would be payable for any requests made after the expiry of 90 days as above and all unclaimed amounts for such unutilized or no show air or hotel booking shall be deemed to have been forfeited.
(x). Agents will be responsible for maintaining all related documents including confirmation from the travellers that the amount paid by them for travel outside of India is in within the annual limits for resident individuals as prescribed by the Reserve Bank of India from time to time.
(xi). That our Client shall grant a limited and non-transferable right to you, the customer, to use the website of our Client - www.mipayindia.com for conducting online booking of the various travel services as made available by our Client to you.
(xii). That you, the customer, shall make payment for the services availed by cash/cheque/demand draft/credit card, and in case of non-payment within 7 days of the due date you, the customer, shall be liable to pay interest at the rate of 0.1% per day till the date of payment of the full amount.
(xiii). That you agree to indemnify us from and against any and all losses, liabilities, claims, damages, costs and expenses asserted against or incurred by us that arise out of any breach or non-performance of any covenant or agreement made or obligations to be performed by you;
(xiv). Your client has to be agreed to all the term and condition, when booking any service provided on our website.

AGENT ADM POLICY (Agent/Retailer):

Any ADM arising due to the below mentioned reasons will have to be borne by the Travel Partner

(i). GDS Misuse
(ii). Fictitious Names or Fake Name Like Test Names / Wrong Names
(iii). Duplicate Bookings
(iv). Churning for same segment / Flight / Date
(v). Hold Bookings must be released or issued before Time Limit to avoid Agent Debit Memo (ADM)
(vi). In Case the Booking is aborted at the time of Hold or Booking - Please dont issue tickets multiple times, Please contact our call centre for further action - ADM's will be borne by the agent if not guided by this policy.

Availability

The products and services displayed on the Site may not be available for purchase in your particular country or locality. The reference to such products and services on the Site does not imply or warrant that these products or services will be available at any time in your particular geographical location. You should check with your local adimudra authorized representative for the availability of specific products and services in your area.

Standard Cancellation Policy:

(i). Cancellation within 12 Hours of Scheduled Departure Time must be cancelled with the Airline directy, Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd) will not be liable in any way if the passenger is No Show.
(ii). All Bookings cancelled may attract charges levied by airlines.
(iii). Cancellations must be in the form of Amendment on the portal.
(iv). If a credit has been approved it is valid for 6 months from the date the cancellation was made.

Flight Cancellation Policy:
(i). Flights booked on this website are governed by the terms and conditions of the airfare you purchased and are determined by the Airline (not Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd)).
(ii). In most cases, airfares are fully non-refundable and non-transferable.
(iii). Airline charges or part or full cancellation fees may apply to your particular airfare.
(iv). A Travel Consultant will help you wherever possible within these terms and conditions.

Special Cancellation Conditions: Certain air,car,hotel and tour products will apply additional cancellation charges. These cancellation conditions and costs are located under the pricing on the individual pages and will be clearly advised to you in writing at time of booking.

Amendment Fees: Any amendments made to confirmed bookings will incur a fee; The fees are charged per amendment. This is in addition to any fees that may be levied by the supplier or airline.

Credit Card Chargeback Fees: Any fees charged to Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd) by our credit card payment provider arising from a chargeback or a disputed charge on the cardholder's credit card will be charged to the cardholder. This fee is non-refundable.

Change Of Itinerary After booking Has Commenced: Any alteration or cancellation of services after your booking has commenced can incur penalties. There is no refund for unused services.

Refunds: All refund requests must be in writing, and made direct to us or through the Agent from whom the travel arrangements were purchased. Claims must be made prior to departure time. Refunds will not be made for bookings cancelled due to inclement weather or illness. These must be claimed through your travel Insurance. No refunds will be made for services once travel arrangements have commenced. No guarantee is provided or warranted that any refund will be available. if payment done twice for one transaction, the one transaction amount will be refunded as Deposit in Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd) Account within 07 to 10 working days.

Reporting of Incidents: Any abnormal incidents including injuries, service problems, cancellation of a service or dissatisfaction must be reported to Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd) during the event to allow us an opportunity to rectify the situation or provide assistance.

Validity of Rates: Prices are valid for the dates indicated.

Currency: All rates are quoted in Indian Rupees, or as otherwise indicated.

Payment Options: Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd) offers a secure server for your credit card payments. Alternatively, you can fax through your credit card details to us, send a cheque or make a direct deposit.

Eticket: Eticket details will be email to the address you gave us when you made your reservation within 5 minutes also you get the Eticket copy through Print Eticket tab on top right corner.

Accommodation: Accommodation is as specified in the accommodation section of our web sites. All costs are shown in Indian rupees, unless otherwise stated. We reserve the right to offer alternative accommodation of a similar standard in the case the accommodation operAdimudra (Cojective Digital Payment & Trading Service Pvt Ltd)r overbooks their property or for any reason beyond our control. All rates are subject to change without notice. Not all properties provide instant availability and in these cases Adimudra (Cojective Digital Payment & Trading Service Pvt Ltd) checks availability once we receive the booking request.

Flights: Airfares show instant availability and fares at the time of quoting however we will not proceed with booking flights until your accommodation is confirmed. This is to avoid strict fees charged by airlines for flight amendments. This may result in fare and/or availability changes.Check In / Check Out Times: These vary according to operAdimudra (Cojective Digital Payment & Trading Service Pvt Ltd)r. Generally your accommodation check in is 2pm and check out 10am. Please note that most properties will require a credit card authorisation on check-in and may need to see photo identification. 1. These terms of use, read together with the Privacy Policy located at mipayindia.com ("Privacy Policy"), constitutes a legal and binding contract ("Agreement") between you and Cojective Digital Payments & Trading Services Pvt. Ltd. (CDPTS), a company validly existing under the laws of India ("Adimudra") providing, inter alia, the terms that govern your access to use...

(ii) Adimudra's mobile applications ("Mobile Applications").
(iii) Adimudra's online travel, accommodation, and allied reservation services.
(iv) any other service that may be provided by Adimudra from time to time (collectively referred to as the "Services"). You hereby agree and understand that this Agreement is a binding contract between Adimudra and any person who accesses, browses, or uses the Services in any manner and accordingly you hereby agree to be bound by the terms contained in this Agreement. If you do not agree to the terms contained in this Agreement, you shall not have the right to use the Services and shall forthwith leave the Website and stop using the Mobile Applications. The terms contained in this Agreement shall be accepted without any modification. The use of the Services would constitute acceptance of the terms of this Agreement.

2. You must be 18 (eighteen) years of age or older to register, or visit or use the Services in any manner. By registering, visiting or using the Services, you hereby represent and warrant to Adimudra that you are 18 (eighteen) years of age or older, and that you have the right, authority and capacity to use the Services and agree to and abide by this Agreement. If you are using the Services on behalf of another organization or entity ("Organization"), then you are agreeing to be bound by the Agreement on behalf of that Organization and you represent and warrant that you have the authority to bind the Organization to this Agreement. In that case, "you" and "your" refers to you and the concerned Organization.

3. This Agreement is published in compliance of, and is governed by the provisions of Indian law, but not limited to:
(i) The Indian Contract Act, 1872;
(ii) The Information Technology Act, 2000;
(iii) The rules, regulations, guidelines and clarifications framed thereunder, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 ("SPI Rules"); and
(iv) Information Technology (Intermediaries Guidelines) Rules, 2011 (the "IG Rules").

4. Adimudra authorizes you to view and access the content available on the Services solely for ordering, receiving, delivering and communicating only as per this Agreement. The contents of the Services, information, text, graphics, images, logos, button icons, software code, interface, design and the collection, arrangement and assembly of content on the Website, Mobile Applications or any of the other Services ("Adimudra Content"), are the property of Adimudra and are protected under copyright, trademark and other applicable laws. You shall not modify the Adimudra Content or reproduce, display, publicly perform, distribute, or otherwise use the Adimudra Content in any way for any public or commercial purpose or for personal gain.

5. All rights and liabilities of the Adimudra with respect to any Services to be provided by Adimudra shall be restricted to the scope of this Agreement. In addition to this Agreement, you shall also ensure that you are in compliance with the terms and conditions of the third parties, whose links are contained/embedded in the Services, with whom you choose to transact with. It is hereby clarified that Adimudra shall not be held liable for any transaction between you and any such third party.
